An Act relating to Medicaid fraud; amending 22 O.S. 2021, Section 152, as amended by Section 1, Chapter 174, O.S.L. 2022 (22 O.S. Supp. 2023, Section 152), which relates to statute of limitations for criminal procedure; including adult sexual abuse to all sexual abuse crimes; amending 22 O.S. 2021, Section 1402, which relates to definitions in the Oklahoma Racketeer-Influenced and Corrupt Organizations Act; adding to definition to include neglect and abuse to elderly adults; adding to definition to include Medicaid fraud; amending 56 O.S. 2021, Section 1006, which relates to penalty for Medicaid fraud; decreasing the dollar threshold amount for a felony and misdemeanor; adding the fine and imprisonment amounts; and providing an effective date.

After reviewing HB 3668 more closely, we have decided to stop tracking it, as it falls outside of Metriarch’s focus.
According to the state prepared summary of HB 3668, the measure increases the penalty for Medicaid fraud. Fraud could be labeled racketeering and the threshold for felony fraud is reduced from $2,000 to $1,000.
The author’s presentation has solely described HB 3668 as a measure to protect vulnerable adults in a medical setting, which is also in the bill.
Heavily penalizes Medicaid fraud. Those who are found to have committed fraud required to pay back three times the claimed and received money, or $10,000, whichever is higher. Three year prison also possible.
“Person” is defined as any entity from individuals to corporations.
