In his message, Gov. Stitt stated he doesn’t think APRNs should be allowed to prescribe Schedule III-V medications without supervision. He believes the current way, where APRNs can work independently but need some supervision for prescribing, is satisfactory.

The Floor Substitute for Senate Bill 458 allows Advanced Practice Registered Nurses (APRN) recognized as Certified Nurse Practitioners, Certified Nurse-Midwives, or Clinical Nurse Specialists to prescribe drugs independent of physician supervision after completing a minimum of 6,240 hours of practice with supervised prescriptive authority.
The measure authorizes the Oklahoma Board of Nursing, the State Board of Medical Licensure and Supervision, and the State Board of Osteopathic Examiners to establish a uniform set of rules governing the supervision of Advanced Practice Registered Nurses (APRNs). These rules will delineate supervision requirements for APRNs who have not obtained independent prescriptive authority, including setting reasonable limits on the monetary fees that supervising physicians can charge APRNs for their supervision services.
The measure establishes caps on the number of APRNs that a single physician may supervise, with provisions allowing physicians to request waivers under certain conditions.
The measure also requires licensed practitioners to carry malpractice insurance or demonstrate financial responsibility, with exceptions for those employed by federal agencies. The State Board of Medical Licensure and Supervision and the State Board of Osteopathic Examiners are also required to maintain and update a list of physicians available to supervise APRNs on their respective websites.
